These Terms of Service ("Terms") govern your use of the Livewire Cutting Systems website located at www.livewirecuttingsystems.com and your purchase of products from Livewire Cutting Systems ("we," "us," or "our"). By accessing our website or placing an order, you agree to be bound by these Terms.

1. Acceptance of Terms

By using this website or purchasing from us, you confirm that you are at least 18 years of age, have the legal authority to enter into a binding agreement, and agree to these Terms in full. If you do not agree, do not use this website or place an order.

2. Products

Livewire Cutting Systems sells cutting flag systems (also known as mechanical cow trainers), replacement parts, and accessories for use in cutting horse and cow horse training. All products sold are new unless otherwise explicitly stated.

Product descriptions, specifications, and pricing are subject to change without notice. We make every effort to display product information accurately; however, we do not warrant that product descriptions or other content is error-free.

3. Pricing and Payment

All prices are listed in US Dollars (USD). We accept the payment methods displayed at checkout. By submitting payment, you represent that you are authorized to use the selected payment method.

We reserve the right to refuse or cancel any order at our discretion, including orders that appear to be placed fraudulently or in error. If your order is cancelled after payment is processed, a full refund will be issued.

4. Orders and Contract Formation

Placing an order constitutes an offer to purchase. A contract is formed when we confirm your order and process payment. You will receive an order confirmation email — retain this for your records.

We reserve the right to limit order quantities or refuse service to any customer.

5. Shipping and Delivery

Shipping is subject to our Shipping Policy, which is incorporated into these Terms by reference. Risk of loss and title for products pass to you upon delivery to the carrier.

6. Returns and Refunds

Returns and refunds are governed by our Return Policy, which is incorporated into these Terms by reference.

7. Warranty

Limited Warranty: Livewire Cutting Systems warrants that its products are free from defects in materials and workmanship for one year on remotes, two years on drive units from the date of purchase. 

This warranty covers manufacturing defects only. It does not cover:

•        Damage caused by misuse, accident, improper installation, or neglect

•        Normal wear and tear

•        Damage caused by operation outside the intended use described in the product manual

•        Modifications made to the product by anyone other than Livewire Cutting Systems

To make a warranty claim, contact us at Support@livewirecuttingsystems.com with your order number and a description of the defect. We will repair or replace the defective product at our sole discretion. This warranty gives you specific legal rights; you may also have other rights that vary by state.

8. Assumption of Risk — Equine Activities

Livewire Cutting Systems products are designed for use in equine training environments. Equine activities carry inherent risks including, but not limited to, injury from horses, falls, and equipment. By purchasing and using our products, you acknowledge and assume all risks associated with equine activities and the use of our equipment.

You are solely responsible for:

•        Using the product in accordance with all provided instructions and safety guidelines

•        Ensuring the product is properly installed and maintained

•        Training and supervising all individuals who operate the equipment

•        Compliance with all applicable laws and regulations in your jurisdiction

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LIVEWIRE CUTTING SYSTEMS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF OUR PRODUCTS OR WEBSITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR PURCHASE SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT IN QUESTION.

Some states do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you.

10. Indemnification

You agree to indemnify, defend, and hold harmless Livewire Cutting Systems and its owners, employees, and agents from and against any claims, liabilities, damages, losses, or expenses (including reasonable attorneys' fees) arising out of or in connection with your use of our products, your violation of these Terms, or your violation of any third-party rights.

11. Intellectual Property

All content on www.livewirecuttingsystems.com — including text, images, logos, product designs, and videos — is the property of Livewire Cutting Systems and is protected by applicable intellectual property laws. You may not reproduce, distribute, or use our content without prior written permission.

12. Privacy

Your use of our website is also governed by our Privacy Policy, available at www.livewirecuttingsystems.com/policies/privacy-policy.

13. Changes to These Terms

We reserve the right to update these Terms at any time. Changes become effective upon posting to www.livewirecuttingsystems.com. Your continued use of our website or placement of an order after changes are posted constitutes acceptance of the updated Terms. We encourage you to review this page periodically.

14. Governing Law and Dispute Resolution

Governing law: These Terms shall be governed by the laws of the State of California, without regard to its conflict of law provisions. 

Jurisdiction: Any disputes arising under these Terms shall be resolved in the courts located in Tuolumne County, California. 

You and Livewire Cutting Systems agree to first attempt to resolve any dispute informally by contacting us. If a dispute cannot be resolved informally within 30 days, either party may pursue formal legal remedies.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

16. Entire Agreement

These Terms, together with our Return Policy, Shipping Policy, and Privacy Policy, constitute the entire agreement between you and Livewire Cutting Systems regarding your use of our website and purchase of our products.
